In recent year, the Africa-Middle East (AME) Region and the global economy have been adversely affected by the public health crisis of COVID-19. The disproportionate adverse effect of the pandemic across industries means that, among other things, some companies receive less than usual margins/losses; or face major cash flow difficulties; or have had to borrow more at negotiated rates from banks or related parties that might vary from what would have been the case during normal times, with implications for Transfer Pricing (TP). Specifically, these particular circumstances and the reactions of governments to the pandemic have created technical difficulties for the enforcement of the OECD Transfer Pricing (TP) Recommendations and the Arm’s Length Concept (ALP).
